The Opportunity :

 To support Trade Center of Excellence (TCOE) compliance and export control team by providing appropriate risk analysis and potential mitigation actions for sanctions and embargo transactions and customer relations across the enterprise. To provide training on sanctions and embargo regulations, and overall trade compliance to support the enterprise.


Job Requirements:

  • Provide daily monitoring and due diligence review on business unit transactions involving potential countries, transactions impacted or parties (e.g., Venezuela, Russia, Cuba, and Iran) to ensure transactions comply with all sanctions and embargo regulations.
  • Duties will also include the drafting and review of policies and procedures in the sanctions and embargo space.  
  • Perform detailed analysis on beneficial ownership to identify parties that are blocked by operation of 50% or more ownership rules (beneficial ownership) to identify entities that should be listed or de-listed due to changes in beneficial ownership of SDN entities.
  • Monitor daily announcements of sanctions and embargo regulatory actions from various governments around the globe and draft communications explaining the regulatory actions and requirements for the business units to comply.
  • Assist Licensing/ECCN Manager in development of training materials and collaboration with the Trade COE Screening Team regarding sanctions and embargoes globally.
  • Highlight the differences in sanctions and embargoes programs, identify countries where complete embargoes were in place vs countries with higher complexity sanctions programs.
  • Review the differences in the Trade COE Sanctions and Embargoes due diligences processes.
  • Provide guidance to the screening team on relevant sanctions matters, such as beneficial ownership rules.
  • Support Licensing/ECCN Manager to facilitate review of Trade COE sanctions compliance tools and process as requested by relevant Caterpillar business units, such as Solar Turbines and Financial Services Division.
  • Provide training to business unit compliance teams to build awareness of how the sanctions compliance tools are being utilized in the due diligence process for transactions subject to sanctions or embargoes.
  • Represent Trade COE Sanctions and Embargo team on relevant Caterpillar working groups.
  • Collaborate with Global Warranty group on embargo blocks for warranty claim and Caterpillar Insurance Services Company extended warranty enrollments. Review thousands of embargo blocks for transactions submitted through the Global Warranty System. Identify entities that are blocked due to sanctions. Work with Global Warranty to perform additional due diligence required on warranty claims for Sectoral Sanctions entities (SSIs) to ensure entities are not engaged in prohibited activities under the SSI Directives.
  • In coordination with the Licensing/ECCN Manager, participate in Risk Owner Compliance Reviews as required; provide guidance on recommended best practices.
  • Assist Licensing/ECCN Manager in providing guidance on the management of the Caterpillar internal restricted party list.
  • Provide guidance to GAS and the Global Warranty Divisions on marine vessel due diligence for sanctions and embargo screening. For transactions involving vessels in sanctioned or embargoed countries, provide recommendations for the process to review the vessel ownership and transit routes. Evaluate information gathered by the business units to determine if providing parts or services to support a vessel would require a license or authorization from the relevant government.
  • Provide guidance for screening and blocking of Dealer customers located in sanctioned or embargoed countries.
  • Provide guidance for responses on banking inquiries related to sanctions regulations reporting requirements.
  • Employee may also be responsible for performing other job duties occasionally as assigned.

Background/Experience:

  •  Requires a college or university degree.  
  • Must have at least 2-3 years of experience in trade operations, ownership relations, logistics operations, compliance operations, compliance software, or customer relations.
  • Familiarity with sanctions and embargoes regulations, export controls, and transaction restricted party screening is also required
  • Must have good communications and human relations skills. 

Top candidates :

  • 2-3 years of experience in delivering sanctions technical and advisory support. Demonstrated compliance commitment and experience.
  • Previous and proven leadership of teams or projects.  
  • Ability to adapt to and adjust processes and recommendations in a highly complex, ambiguous and fast changing international trade context.
  • Experienced with implementing and/or managing global initiatives/processes controls across multiple businesses and countries; ability to find root-causes and work through creative and achievable resolutions
  • Ability to collaborate vertically and horizontally, across levels and various business functions, and with external parties.
  • Excellent interpersonal and collaborative skills with demonstrated ability to balance commercial and compliance priorities and imperatives impact, influence, and negotiate with multiple stakeholders.
  • This position has been evaluated using Hay Standard Process and has taken into consideration
